El anuncio lo ha hecho hoy la Secretaria del DHS, Janet Napolitano, en su memor\u00e1ndum oficial, <strong>\u00ab<\/strong><a href=\"https:\/\/www.dhs.gov\/xlibrary\/assets\/s1-exercising-prosecutorial-discretion-individuals-who-came-to-us-as-children.pdf\" target=\"_blank\" rel=\"noopener\"><strong>Ejercicio de la discreci\u00f3n fiscal con respecto a las personas que llegaron a Estados Unidos siendo ni\u00f1os\u00bb.<\/strong><\/a>. El memor\u00e1ndum establece qui\u00e9n puede optar a permanecer en EE.UU. bajo el programa de <strong>Acci\u00f3n Diferida<\/strong> en virtud de este acto de <strong>discreci\u00f3n fiscal<\/strong>. Los factores que deben tenerse en cuenta son<\/p>\n<ul>\n<li>llegaron a Estados Unidos con menos de diecis\u00e9is a\u00f1os;<\/li>\n<li>ha residido de forma continuada en Estados Unidos durante al menos los cinco a\u00f1os anteriores a la fecha de este memor\u00e1ndum y est\u00e1 presente en Estados Unidos en la fecha de este memor\u00e1ndum;<\/li>\n<li>est\u00e1 actualmente escolarizado, se ha graduado en el instituto, ha obtenido un certificado de desarrollo de la educaci\u00f3n general o es un veterano de la Guardia Costera o de las Fuerzas Armadas de Estados Unidos con licenciamiento honorable;<\/li>\n<li>no haya sido condenado por un delito grave, un delito menor significativo, m\u00faltiples delitos menores, o suponga una amenaza para la seguridad nacional o la seguridad p\u00fablica; y no tenga m\u00e1s de treinta a\u00f1os.<\/li>\n<\/ul>\n<p>Las personas tambi\u00e9n deben completar una comprobaci\u00f3n de antecedentes y, en el caso de las personas que presenten una solicitud al USCIS y no est\u00e9n sujetas a una orden definitiva de expulsi\u00f3n, deben tener 15 a\u00f1os o m\u00e1s. Los inmigrantes ante un juez de inmigraci\u00f3n que ya se enfrentan a la deportaci\u00f3n tambi\u00e9n pueden solicitar la protecci\u00f3n, y los abogados del ICE han recibido instrucciones para poner en marcha un proceso en un plazo de 60 d\u00edas a partir del anuncio de Napolitano.
